PRIVACY STATEMENT
HML Investments Enterprises, Inc. (d/b/a HML Investments)
Originally effective November 22, 2022 | Last updated August 17, 2026
YOUR RIGHTS AND OPTIONS
You do not have to provide personal information to enjoy most of the features of our online and mobile resources. Moreover, you can opt out of certain activities like newsletters and announcements. Residents of California and data subjects whose personal information was obtained while they were in the GDPR Jurisdictions have certain additional rights.
“GDPR Jurisdictions” means the countries composed of the European Economic Area (including Iceland, Liechtenstein, and Norway) and the following countries: Austria, Belgium, Bulgaria, Croatia, Cyprus, Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, Malta, the Netherlands, Poland, Portugal, Romania, Slovakia, Slovenia, Spain, and Sweden.
Furthermore, Andorra, Argentina, Canada (only commercial organizations), the Faroe Islands, Guernsey, Israel, the Isle of Man, Jersey, New Zealand, Switzerland, Uruguay, and Japan have received an “adequacy decision” from the European Commission and adhere to the material terms of the GDPR. Switzerland also has its own data protection regime under its Federal Act on Data Protection (“FADP”).
The GDPR no longer has jurisdiction over the United Kingdom. Since the United Kingdom (“UK”) has now formally left the European Union, it is no longer regulated domestically by the material terms of the GDPR. The United Kingdom General Data Protection Regulation (“UK-GDPR”) is the UK’s data privacy law that governs the processing of personal data domestically.
If we are using personal information you provided to us in order to enable us to send you materials, such as newsletters or product alerts via text or email, and you decide you don’t want to receive such materials, you may opt out by following the opt-out instructions in the email or other communication (for example, by responding to the text with “STOP”), or by contacting us using the contact information below. When we receive your request, we will take reasonable steps to remove your name from our distribution lists. You need to understand it may take a period of time to remove your name from our lists after your request, and due to such latency you may still receive materials for a period of time after you opt out. In addition to opting out, you have the ability to access, amend, and delete your personal information by contacting us using the contact information below.
Some browsers have a “do not track” feature that lets you tell websites that you do not want to have your online activities tracked. At this time, we do not specifically respond to browser “do not track” signals.
CHILDREN’S PRIVACY
Federal law imposes special restrictions and obligations on commercial website operators who direct their operations toward, and collect and use information from, children under the age of 13. We take those age-related requirements very seriously, and consistent with them we do not intend for our online and mobile resources to be used by children under the age of 13 without first obtaining the verifiable consent of such child’s parent or legal guardian. Moreover, we do not knowingly collect personal information from minors under the age of 13; only a parent or legal guardian may provide such information after adhering to our verification process for submitting such information via the online and mobile resources.
Our services are directed to real estate investors, builders, and other business borrowers, and are not intended for use by anyone under the age of 18. If we become aware that anyone under the age of 18 has submitted personal information to our online and mobile resources, we will delete that information and will not use it for any purpose whatsoever. If you believe that someone under the age of 18 has submitted personal information to our online and mobile resources, please contact us at info@hmlinvestments.com. We encourage parents and legal guardians to talk with their children about the potential risks of providing personal information over the Internet.
HOW WE PROTECT COLLECTED PERSONAL INFORMATION
We will take all reasonable security precautions to protect the personal information you provide to our online and mobile resources. We have adopted a security program that includes technical, organizational, administrative, and other security measures designed to protect, in a manner consistent with accepted industry standards and applicable law, against anticipated or actual threats to the security of personal information (the “Security Program”). We cannot, however, guarantee that your information, whether during transmission or while stored on our systems or otherwise in our care, will be free from unauthorized access, or that loss, misuse, destruction, or alteration will not occur. Except for our duty to maintain the Security Program under applicable law, we disclaim any other liability for any such theft or loss of, unauthorized access or damage to, or interception of any data or communications, including personal information. We have every reason to believe our Security Program is reasonable and appropriate for our business and the nature of foreseeable risks to the personal information we collect. We further periodically review and update our Security Program, including as required by applicable law.
Nonetheless, as part of our Security Program, we have specific incident response and management procedures that are activated whenever we become aware that your personal information was likely to have been compromised. We further require, as part of our vendor and business partner oversight procedures, that such parties notify us immediately if they have any reason to believe that an incident adversely affecting personal information we provided to them has occurred.
THE CALIFORNIA CONSUMER PRIVACY ACT
When we collect personal information from California residents, we become subject to, and those residents have rights under, the California Consumer Privacy Act, as amended by the California Privacy Rights Act (“CCPA”). This section of our statement is used to allow us to fulfill our CCPA obligations and explain your CCPA rights. For purposes of this section, the words “you” and “your” mean only such California residents.
What do we collect from California residents?
We collect the following categories of personal information: identifiers such as name, address, email address, telephone number, IP address, and other similar identifiers; personal information described in subdivision (e) of Section 1798.80 (California customer records statute) such as name, address, telephone number, and financial account information; commercial information such as products or services inquired about or obtained; internet and other electronic network activity information such as browsing history, search history, and information regarding your interaction with our website and advertisements; geolocation data including approximate geographic location derived from IP address; professional or employment-related information; and audio, electronic, or other similar information such as recorded telephone calls.
We may disclose this information for one or more business purposes permitted by the CCPA. We do not sell your personal information for monetary consideration. We do disclose certain identifiers and internet activity information to advertising and analytics providers in connection with our digital advertising, which may constitute “sharing” for cross-context behavioral advertising under the CCPA. You may opt out of such sharing using the “Do Not Sell or Share My Personal Information” link on our website or by contacting us at info@hmlinvestments.com.
Certain personal information we collect in connection with brokering loans may be exempt from the CCPA because it is subject to the federal Gramm-Leach-Bliley Act and its implementing regulations, or to the Fair Credit Reporting Act. Where an exemption applies, the rights described in this section may not extend to that information.
Rights of California residents
You have the following rights under the CCPA:
The right to know what personal information we have collected about you, the categories of sources, the purposes for collecting it, and the categories of third parties to whom we disclose it.
The right to access the specific pieces of personal information we hold about you.
The right to request correction of inaccurate personal information.
The right to request deletion of personal information we have collected from you, subject to legal exceptions.
The right to opt out of the sale or sharing of your personal information.
The right to limit our use and disclosure of sensitive personal information.
The right not to be discriminated against for exercising any of these rights.
It’s important to us that you know that if you exercise these rights, we will not discriminate against you by treating you differently from other California residents who use our sites and mobile resources or obtain our services but did not exercise their rights.
You may exercise your right to know or access up to two times every 12 months. To do so, contact us at info@hmlinvestments.com. We may ask you to fill out a request form. The CCPA only allows us to act on your request if we can verify your identity or your authority to make the request, so you will also need to follow our instructions for identity verification. An authorized agent may submit a request on your behalf with your written permission and proof of the agent’s authority.
If you make a verifiable request per the above, we will confirm our receipt and respond within the time frames prescribed by the CCPA.
How long we keep your information
We retain personal information for as long as necessary to fulfill the purposes described in this statement, including to service and administer loans we have brokered, to maintain business records, and to comply with our legal, licensing, tax, and recordkeeping obligations. Retention periods vary by category of information and by the applicable legal requirement.
THE EU GENERAL DATA PROTECTION REGULATION
We do collect or otherwise obtain personal information from data subjects located in the GDPR Jurisdictions. We fulfill our GDPR obligations with respect to our workforce and job applicants, our customers (and their own end-clients), and our vendors and business partners through a series of separate notices, contracts, or other terms provided to them at the time, and in the manner and form, that the GDPR and local law within each GDPR Jurisdiction requires.
We describe, in the immediately following section of this statement, how we comply with the GDPR for personal information collected from visitors to and users of our online and mobile resources while they were in a GDPR Jurisdiction. Thus, for purposes of that section, the words “you” and “your” mean only such GDPR Jurisdiction-based visitors and users.
What do we collect from you in the GDPR Jurisdictions and how do we use it?
We collect from you the categories of personal information already described. The lawful basis on which we rely for such collection, later use, and disclosure is what the GDPR refers to as legitimate interest. As stated elsewhere in this statement, we do not sell any of your personal information to third parties for monetary consideration, nor do we use it for automated decision making.
Cross-border data transfers and third-party processors
If we transfer personal information from the GDPR Jurisdictions to a location that has not been deemed by the European Commission to have adequate privacy protections, we do so in the manner the GDPR permits.
Rights of data subjects in the GDPR Jurisdictions
While we attempt to allow all visitors and users of our online and mobile resources to exercise a degree of control over their personal information, under the GDPR we have a legal obligation to do so for you. More specifically, with respect to personal information collected from you while you were in a GDPR Jurisdiction, you have the rights of transparency, access, correction and deletion, portability, information about who processes your data and what, why, and where it is processed, and restriction of or objection to processing.
If you would like to exercise any of these rights, please contact info@hmlinvestments.com. Your ability to exercise these rights is subject to certain conditions and exemptions that you can read about in Articles 12 through 23 of the GDPR. Among those conditions is our right to decline part or all of a request if we cannot satisfy our reasonable doubts and concerns about your identity in a manner that helps us minimize the risk that unauthorized persons might use a GDPR right to access your personal information. We will respond to all requests without undue delay, and in accordance with the time frames, if any, prescribed by the GDPR. If you are not satisfied with how we use your personal information or respond to your requests, you have the right to complain to your data protection regulator.
RIGHTS OF DATA SUBJECTS IN OTHER JURISDICTIONS
In other jurisdictions with similar data privacy regulations, including but not limited to Virginia, Colorado, Connecticut, Utah, Texas, Oregon, Montana, and Florida, we may collect from you the categories of personal information already described. We collect and manage (including disclose) such data in compliance with applicable local laws, which may give you rights to access, correct, delete, or obtain a copy of your personal information and to opt out of certain processing. To exercise any such right, contact us at info@hmlinvestments.com. As noted, we do not sell any of your personal information to third parties for monetary consideration, nor do we use it for automated decision making.

  2. Governing Law

These ToS and any disputes arising out of or related to them will be governed by the laws of [Florida, United States], without regard to its conflict of laws principles.

  1. Arbitration Agreement
  2. Arbitration

You and HML Investments Enterprises, INC agree that any dispute, controversy, or claim arising out of or relating to these ToS, the Services, or any relationship between the parties, including claims based in contract, tort, statute, fraud, misrepresentation, or any other legal theory, shall be resolved through binding arbitration using National Arbitration and Mediation.

Notwithstanding the foregoing, this Arbitration Agreement does not apply to, and shall not be construed to require arbitration of, any claim or transaction for which mandatory pre-dispute arbitration is prohibited by applicable federal or state law, including without limitation 15 U.S.C. § 1639c(e) as to consumer credit transactions secured by a dwelling. Any such claim is excluded from the scope of this Arbitration Agreement, and its exclusion shall not render any other provision of this Arbitration Agreement unenforceable. Either party may also bring an individual claim in small claims court, provided the claim remains in that court and proceeds on an individual basis.

The arbitration shall be administered by National Arbitration and Mediation (“NAM”) under NAM’s Comprehensive Dispute Resolution Rules and Procedures in effect at the time the claim is filed, which are available at www.namadr.com. If NAM determines that the dispute constitutes a consumer transaction, NAM’s fee schedule for consumer disputes shall apply.. The arbitration will be conducted by a single arbitrator with experience in resolving disputes related to the type of services provided by HML Investments Enterprises, INC. The arbitrator’s decision shall be final and binding on all parties.

The arbitration shall take place in Miami, Florida or at another mutually agreed location. If the amount in controversy does not exceed $10,000, you may choose to have the arbitration conducted by telephone, video conference, or based solely on written submissions, subject to the discretion of the arbitrator.

The parties shall share the costs of arbitration, including arbitrator fees, equally, unless the arbitrator determines that such apportionment is not appropriate given the circumstances of the case. Each party shall bear its own legal fees and expenses, unless the arbitrator awards legal fees and costs to the prevailing party under applicable law.

You agree that any arbitration or proceeding shall be conducted only on an individual basis and not as a class, consolidated, or representative action. The arbitrator may not consolidate more than one person’s claims or preside over any form of a representative or class proceeding.

If any portion of this Arbitration Agreement is found to be unenforceable, the remaining portions shall remain in full force and effect. However, if the class action waiver in this Arbitration Agreement is found to be unenforceable, the entire Arbitration Agreement shall be null and void.

In the event that this Arbitration Agreement is found not to apply to a dispute, you and HML Investments Enterprises, INC agree that any non-arbitrable disputes shall be resolved exclusively in the state or federal courts located in Miami, Florida, and you consent to venue and personal jurisdiction in such courts.

Any arbitration proceedings, documents, and information exchanged between the parties in connection with such proceedings, and any final arbitration award, shall be strictly confidential, except as necessary to enforce or challenge the arbitration award in a court of law, or as required by law.

  1. Miscellaneous
  2. Entire Agreement

These ToS, together with our Privacy Policy, constitute the entire agreement between you and HML Investments Enterprises, INC concerning the Services and supersede any prior agreements, whether written or oral.

  1. Severability

If any provision of these ToS is found to be unlawful, void, or unenforceable, then that provision shall be deemed severable from these ToS and shall not affect the validity and enforceability of any remaining provisions.

  1. Waiver

No waiver of any term of these ToS shall be deemed a further or continuing waiver of such term or any other term, and HML Investments Enterprises, INC failure to assert any right or provision under these ToS shall not constitute a waiver of such right or provision.

  1. Assignment

You may not assign your rights or obligations under these ToS without our prior written consent. We may assign our rights and obligations under these ToS without restriction.

  1. Force Majeure

We shall not be liable for any failure or delay in our performance under these ToS due to causes beyond our reasonable control, including, but not limited to, acts of God, war, terrorism, strikes, supply chain disruptions, pandemics, power outages, or governmental restrictions.

  1. Headings

The headings used in these ToS are for convenience only and have no legal or contractual effect.
